The Gujarat High Court, recently asked the Gujarat Metro Rail Corporation (GMRC) to not undertake demolition of houses in Shahpur area of the city to build track network for Ahmedabad-Gandhinagar Metro railway project.
It may be noted that around two months ago, GMRC has provided alternative accommodation to those whose homes will be demolished. The petition was filed by five residents after they got GMRC's notice to vacate their houses. They had sought postponement of the demolition in wake of the coronavirus pandemic.
"We submitted to the court that due to the extraordinary circumstances of the outbreak of Covid-19, time should be granted to the residents to remove their belongings and shift out of residential accommodation," said Apurva Jani, counsel appeared for the five residents.
On the other side, GMRC submitted, "One of the five petitioners has already shifted to his alternative accommodation, while others had agreed to shift. Apart from making arrangements for the shifting, allowances of Rs 50,000 will be paid as and when they come to collect the keys of the alternative accommodation already allotted to them."
After hearing arguments from both the sides, HC has issued order in favour of the petitioners. "Keeping in view the special circumstances, the corporation may not insist on taking any coercive steps pursuant to the impugned notice till 01.04.2020. This interim protection is granted only looking to the epidemic situation prevailing in the city," observed justice Biren Vaishnav in the order.
